Fanzoona is a content hosting Platform designed for photo & video content creators, cosplay personalities and social media influencers.
The Fanzoona Platform is managed by Group Five Photosports, LLC., of 40 W. Littleton Bl. #210, Littleton, CO, 80120 USA.
This agreement outlines our Terms of Service, Privacy Policy and the general relationship between this Platform, our owners and managers, and the users of this Platform and service.
Please read this Agreement carefully to insure you understand it. If you do not understand the Agreement, or do not accept any part of it, then you may not use the Platform.
General Statements:
By creating a user profile, or a creator profile, on Fanzoona you are agreeing to all of the Terms & Conditions outlined on this page.
The minimum age to use the Platform is 13 years of age.
To be approved as a model or creator on this Platform and begin collecting subscription payments all persons under age 18 must have parental permission.
No full frontal nudity is allowed on this Platform, or to be transferred through the live streams or direct messaging system, on this Platform.
The laws of the United States of America, and the State of Colorado, govern this Platform.
All sales are final. Refunds will only be given in exceptional circumstances.
Fanzoona, the members of Group Five Photosports, LLC and all members of our staff irrevocably reserve the right to remove a user or creator from this Platform at any time for any reason if we determine at our sole discretion it is in the best interest of the Platform, the company, or other users to do so.
Common Words Used Here:
Platform: This term encompasses the Fanzoona.com website, the Fanzoona Progressive Web Application (PWA), the software systems that run the website and PWA, the hosting network, the database systems, the payment and billing systems, and any or all of the digital files within same.
Creator: This is a Photographer, Videographer, Podcaster, YouTuber, Model, TikToker, Cosplayer or other person that maintains a profile here and posts creative content, such as photos or videos, in their feed.
Fan, Follower, User, Subscriber or Customer: This is a user of the Service that pays a fee to Group Five Photosports d/b/a Fanzoona to follow one or more Creators so as to review the creative Content the Creator may post.
Feed: This is the area within the Service where a Creator publishes or posts their creative Content, and also where a Fan scrolls to review the Content.
Content: These are the creative items produced and published by the Creator. Photos, Videos, Audio, Comments within the Feed, and the visual and audio portions of a Live Stream are all considered unique creative Content.
Works: This is another word for content, and represents the terminology used by the United States Copyright Office.
Service: This is a reference to the Fanzoona Platform, and the unique technical services it provides to both the Creators and the Fans.
Terms of Service & General Policies:
Thank you for using Fanzoona, along with the services and features we make available to you as part of the Fanzoona website and PWA (collectively, the "Platform").
The Service allows you to discover Photographers, Videographers, Podcasters, YouTubers, Models, TikTokers, Cosplayers and other creative persons (collectively "Creators") and peruse their Content Feed, which may include photos, videos, the written word and live events delivered by video streaming.
Most Creators on this Platform request a subscription fee to follow their Content Feed. By paying the requested fee you are not gaining ownership rights, collecting rights, distribution or sharing rights, or any Copyright to the visual, audio or written Content posted.
The Platform is not a dating service, social planning service, or party arranging service. Under no circumstances should a person creating a profile here expect to meet live and in person with any of the Creators using the Platform.
The Platform is not a file storage system, file locker, back-up drive, external drive, Dropbox like service, Google Drive like service, iCloud like service or in any way to be considered as a file storage or back-up system for purchases of Content.
The entity providing the Platform is Group Five Photosports, LLC, a company operating under the laws of The United States of America and the State of Colorado, with a postal address of 40 W. Littleton Bl. #210, Littleton, CO, 80120 (hereinafter referred to as "Fanzoona", "we", "us", or "our").
You must be at least 13 years old to use the Platform; however, to be approved as a Creator on this Platform and begin collecting subscription payments all persons under age 18 must have parental permission. If you are under 18, you represent that you have your parent or guardian's permission to use the Platform. Please have them read this Agreement with you.
If you are using the Platform on behalf of a company or organization, by joining here you represent that you have authority to act on behalf of that entity, and that such entity accepts this Agreement.
The content on the Platform includes photos, videos, audio, graphics, text (such as comments and scripts), branding (including trade names, stage names, trademarks, service marks, or logos), interactive features such as Live Streams, and more (collectively, "Content").
All Content, and each and every photo or video, published within this Platform is the sole property of the Creator posting it. By subscribing to any Creator within this Platform you agree that the content of this Platform, along with each individual Feed, photograph, video or live video stream, are intended for personal, noncommercial use only, and further that all Content items posted on this Platform are protected by copyright and other intellectual property laws.
The images, photographs, videos, streams, stories and interviews within this Platform are not to be posted on torrents, forums, personal sites, business sites, Social Media sites or services, file sharing sites, file hosting sites, file lockers, Telegram Groups, Discord channels, public cloud storage systems, sent by email or distributed in any other manner without written permission of the Creator, or if the Creator is a minor, the parent or legal guardian of that Creator.
By using this Platform you agree the laws of United States of America and the State of Colorado shall govern this agreement and further that should you violate these terms, this agreement, or any Creator copyrights that any claims, legal proceedings or litigation arising from those violations, or any matters in connection with this Platform, will be brought solely in the State of Colorado, and you hereby consent to the jurisdiction of such courts.
You agree that infringement of this agreement or the copyrights of the Creators may result in legal action in the United States District Court for the District of Colorado and that you are agreeing to the personal jurisdiction of, and venue in, that court.
That we reserve the right with no consideration, prior notification, or explanation, to cancel, suspend, or modify the entire Platform, or any portion of the Platform, at any time, for any reason, at our sole discretion.
All Content posted is the responsibility of the person or entity that provides it to the Platform. Fanzoona is under no obligation to host or serve Content, or to require Creators to post Content of a certain style to meet the request or demands of any individual user.
You agree that that if you see any Content you believe does not comply with this Agreement, including by violating the no nudity rule or the law, you will report it to us.
You agree that to protect your Fanzoona account you will keep your password confidential and not reuse your Fanzoona account password on third-party applications.
You may access and use the Platform as made available to you, as long as you comply with this Agreement and applicable law. You may view or listen to Content for your personal, non-commercial use only.
The following additional restrictions apply to your use of the Platform.
You are not allowed to access, reproduce, download, distribute, transmit, broadcast, display, sell, license, alter, modify or otherwise use any part of the Platform or any Content except: (a) as expressly authorized by the Platform; or (b) with prior written permission from Fanzoona and, if applicable, the respective rights holders.
You are not allowed to circumvent, disable, fraudulently engage with, or otherwise interfere with any part of the Platform (or attempt to do any of these things), including security-related features or features that (a) prevent or restrict the copying or other use of Content or (b) limit the use of the Platform or Content.
You are not allowed to access the Platform using any automated means (such as robots, botnets or scrapers) except (a) in the case of public search engines, in accordance with the Fanzoona robots.txt file; or (b) with prior written permission.
You are not allowed to collect or harvest any information that might identify a person (for example, usernames or faces), unless permitted by that person.
You are not allowed to use the Platform to distribute unsolicited promotional or commercial content or other unwanted or mass solicitations.
You are not allowed to cause or encourage any inaccurate measurements of genuine user engagement with the Platform, including by paying people or providing them with incentives to increase views, likes, or dislikes, or to increase a feed's subscribers, or otherwise manipulate metrics in any manner.
You are not allowed to misuse any reporting, flagging, complaint, dispute, or appeals process, including by making groundless, vexatious, or frivolous submissions.
You are not allowed to run contests on or through the Platform that do not comply with the Fanzoona guidelines.
You are not allowed to use the Platform to view or listen to Content other than for personal, non-commercial use (for example, you may not publicly screen or display photos or videos from the Platform).
You are not allowed to use the Platform to (a) sell any advertising, sponsorships, or promotions placed on, around, or within the Platform or Content that relate to competing services, adult oriented materials, or pornography.
Using the Platform does not give you ownership of, or rights to, any aspect of the Platform, including usernames or any other Content posted by yourself, by others or by Fanzoona.
The Platform may contain links posted by Creators to third-party Platforms and online services that are not owned or controlled by Fanzoona. You agree that Fanzoona has no control over, and assumes no responsibility for, such Platforms and online services. Be aware when you leave the Platform; we suggest you read the terms and privacy policy of each third-party Platform and online service that you visit.
Fanzoona is constantly changing and improving the Platform. As part of this continual evolution, we may make modifications or changes to all or part of the Platform such as adding or removing features and functionalities, offering new content or services or discontinuing old ones.
We may also need to alter or discontinue the Platform, or any part of it, in order to make performance or security improvements, make changes to comply with law, or prevent illegal activities on, or abuse of, our systems. These changes may affect all users, some users or even an individual user.
If we make material changes that negatively impact your use of the Platform, we'll provide you with reasonable advance notice, except in urgent situations such as preventing abuse, responding to legal requirements, or addressing security and operability issues.
You may stop using the Platform at any time, but all sales are final. Refunds will only be given in exceptional circumstances. Refunds for purchases or recurring charges may be requested by contacting us using the form on the Contact Us page with a full explanation of the circumstances.
Group Five Photosports, LLC, doing business as Fanzoona, reserves the right to grant a refund or a credit applicable to purchases to the site at its discretion. The decision to refund a charge does not imply the obligation to issue additional future refunds. Should a refund be issued for any reason, it will be credited solely to the payment method used in the original transaction.
Fanzoona reserves the right to suspend or terminate your account or your access to all or part of the Platform if (a) you materially or repeatedly breach this Agreement; (b) we are required to do so to comply with a legal requirement or a court order; or (c) we reasonably believe that there has been conduct that creates, or could create, liability or harm to any user, other third-party, Group Five Photosports, LLC, Fanzoona, our staff or our affiliates.
We will notify you with the reason for termination or suspension by Fanzoona unless we reasonably believe that to do so: (a) would violate the law or the direction of a legal enforcement authority; (b) would compromise an investigation; (c) would compromise the integrity, operation or security of the Platform; or (d) would cause harm to any user, other third-party, Group Five Photosports, LLC, Fanzoona, our staff or our affiliates.
Other than as expressly stated in this agreement or as required by law, the Platform is provided "as is" and Fanzoona does not make any specific commitments or warranties about the service. For example, we don't make any warranties about: (a) the content provided through the service; (b) the specific features of the service, or its accuracy, reliability, availability, or ability to meet your needs; or (c) that any content you submit will be accessible on the service.
Except as required by applicable law, Fanzoona, its affiliates, officers, directors, employees and agents will not be responsible for any loss of profits, revenues, business opportunities, goodwill, or anticipated savings; loss or corruption of data; indirect or consequential loss; punitive damages caused by: errors, mistakes, or inaccuracies on the service; personal injury or property damage resulting from your use of the Platform; any unauthorized access to or use of the service; any interruption or cessation of the service; any viruses or malicious code transmitted to or through the service by any third-party; any content whether submitted by a user or Fanzoona, including your use of content; and/or the removal or unavailability of any content.
This provision applies to any claim, regardless of whether the claim asserted is based on warranty, contract, tort, or any other legal theory.
Fanzoona and its affiliates' total liability for any claims arising from or relating to the service is limited to the greater of: (a) the amount of revenue that Fanzoona has paid to you from your use of the service in the 12 months before the date of your notice, in writing to Fanzoona, of the claim; and (b) USD $500.
We may sometimes make changes to this policy. If we make material changes that adversely affect your rights under this these terms we will let you know by posting an announcement on the site or sending you an email in advance of the changes coming into effect. Continuing to use Fanzoona after a change to these terms means you accept the new terms.
These Terms & Conditions are effective immediately for all parties joining Fanzoona on or after May 1, 2024.
By joining Fanzoona you irrevocably agree to all of the Terms, Conditions and Policies stated above.
